U.S. Chamber: EPA using 'nuclear option' as everyday tool

Byers said the EPA should have held listening sessions on the rule in Wyoming and other markets where energy matters heavily to the local economy. As was, the closest listening session was in Denver, about 350 miles from Gillette. An EPA official this summer told the Business Report that listening sessions were held only in regional seats for the agency. But Byers said they didn’t even do sessions in every one of the 10 regions. 
 
Byers also criticized what he sees as EPA’s general jurisdictional change under the current administration. He said under both President Clinton and President George W. Bush, the EPA ousted state implemented plans only once on Clean Air Act and Clean Water Act issues which, by definition, are supposed to be state-driven. However, he said the tactic has been used 52 times during Obama’s first six years in office.
