The Air Stewardship Coalition appreciates the opportunity to submit these comments and
the attached Ramboll Technical Memorandum in support of the U.S. Environmental Protection
Agency’s proposal to deny the petition submitted by the New York Department of
Environmental Conservation under Section 126 of the Clean Air Act. The Petition claims areas
in the New York metropolitan area and western New York face issues with compliance with the
2008 and 2015 ozone national ambient air quality standards (NAAQS) due to interstate transport

Pursuant to Circuit Rule 27(g)(1), the undersigned Petitioners and Petitioner-Intervenors hereby move for dismissal of the petitions for review in these consolidated cases as moot, with each party to bear its own costs. On July 8, 2019, Respondent United States Environmental Protection Agency (“EPA” or “Agency”) published in the Federal Register a final rule repealing the Clean Power Plan—the rule at issue in these cases. 84 Fed. Reg. 32,520 (July 8, 2019). Pursuant to Circuit Rule 27(g)(2), EPA’s final rule repealing the Clean Power Plan is attached to this motion.

The conventional wisdom has been that there was simply no appetite in Congress this year to take meaningful, effective steps to address climate change. It’s argued that the issue is not a priority for the Trump Administration, and there has seemingly been far too much division on Capitol Hill for Republicans and Democrats to work together on this important issue.
