The U.S. Chamber of Commerce submits these comments in support of the Fish and Wildlife Service’s (FWS) and National Marine Fisheries Service’s (NMFS) (collectively, the Services’) proposed revisions to portions of those regulations that implement section 4 of the Endangered Species Act of 1973 (ESA or Act).1  The Chamber recognizes the need to protect species threatened with extinction, but the Services must also avoid unnecessary impediments to land and natural resources development.  The Services can balance endangered species protection with property rights and compliance costs using sound science.
